Terms and Conditions

These Terms form a binding agreement between you and Eduwizz Academy(“Eduwizz”, “we”, “us”). They apply to every service we provide: classroom coaching, online and recorded classes, tuition, the Eduwizz mobile application (“the App”), question banks, study material, Dataflow assistance, exam registration and any related support.

By enrolling, making payment, creating an account, signing in, attending a class, or using the App in any way, you confirm that you have read, understood and accepted these Terms in full. If you do not agree, do not enrol and do not use our services.

Where a parent, guardian, sponsor, employer or agent enrols on your behalf, they accept these Terms for you and you remain bound by them.

• You must be 18 years or older to hold an account. If you are under 18, a parent or guardian must create and operate the account and accepts full responsibility for it.
• All information you give us at registration must be true, complete and kept up to date. Giving false, incomplete or misleading information is a material breach of these Terms.
• One account per student. Your login is strictly personal. It must not be shared, lent, sold, transferred or used by more than one person.
• We may limit the number of devices on which your account can be used and may log you out of other devices at any time.
• You are fully responsible for everything done under your account, including by anyone you allow to use it. Report suspected unauthorised use to info@eduwizz.academy immediately.

• Fees are payable in Indian Rupees by the method we advise at the time of enrolment. Enrolment is confirmed only once payment is received in full and we have activated your access.
• Fees quoted are for the specific course, batch, duration and validity period confirmed to you at enrolment. Fees are inclusive of applicable taxes unless stated otherwise.
• Payment gateway, bank, UPI, card and currency-conversion charges are borne by you and are never refundable.
• Where instalments are permitted, the full course fee remains due. Missing an instalment allows us to suspend access immediately until the account is cleared, and the balance remains payable.
• We may revise fees at any time for future enrolments and batches. This does not affect a course you have already paid for.
• Chargebacks. Raising a chargeback, payment reversal or dispute for a service that has been validly provided is a serious breach of these Terms. We may immediately suspend access, recover the disputed amount plus any bank or administrative charges from you, and pursue recovery.

• Once you have enrolled and paid, the enrolment is final. No refund, no cancellation, no cash back and no adjustment will be given except in the limited cases listed below.
• Digital content is non-refundable once accessed. Recorded classes, live sessions, notes, PDFs, e-books, question banks, mock tests and subscription access are supplied to you immediately on enrolment. You expressly request immediate access and acknowledge that this content cannot be returned once made available.
• No pro-rata refunds. Fees are charged for making the course available to you, not for the number of classes you actually attend. Partial attendance, non-attendance or early discontinuation does not reduce the fee payable.
• Fees are not transferable to another person, another course, another batch or another account, and cannot be held as credit, unless we agree in writing at our sole discretion.
• No refund is due if you change your mind, discontinue, are unable to attend, face personal, medical, work, travel or visa circumstances, are dissatisfied with the teaching, or do not achieve your desired examination, licensing, employment or visa outcome.
• No refund is due where access is suspended or terminated because you breached these Terms.

Limited exceptions

A refund will be considered only where:

• you were charged twice for the same enrolment; or
• payment was taken but access was never granted, and we are unable to resolve it within 7 working days of you reporting it; or
• we cancel a batch or course entirely before it begins and cannot offer you a suitable alternative.

Approved refunds are returned to the original payment method within 15 working days, less any non-recoverable gateway or bank charges. Requests must be raised in writing to info@eduwizz.academy within 15 days of the event complained of.

• Access is granted for the validity period confirmed at enrolment and expires automatically at the end of it. Expired access is not extended or refunded, though we may offer a paid extension at our discretion.
• Access is a limited, personal, non-exclusive, non-transferable licence to view the content for your own study only. You acquire no ownership of any content.
• We may reasonably change class timings, faculty, batch schedules, syllabus sequencing, platform or delivery mode (online, offline or hybrid) where necessary. Such changes do not entitle you to a refund.
• We may add, update, correct or withdraw content at any time, including where an examining body changes its syllabus or rules.
• Where a class cannot run as scheduled, we will reschedule it or provide a recording. This is your sole remedy for a missed session.
• You are responsible for your own device, software, electricity and internet connection. Problems at your end are not grounds for a refund or extension.

All content, including videos, live classes, recordings, notes, question banks, mock tests, images, designs, branding, the Eduwizz name and logo, and the App itself, is owned by Eduwizz or its licensors and protected by the Copyright Act, 1957 and other laws.

You must not:

• record, screen-record, screenshot, photograph, download or copy any class or material;
• share, forward, upload, resell or post content on WhatsApp, Telegram, Google Drive, YouTube, social media, any website or any other channel;
• use the content to teach, coach, tutor or train any other person, or for any commercial purpose;
• share, sell or rent your login;
• reverse-engineer, decompile, scrape, crawl, or tamper with the App or its security.

You agree to behave respectfully towards our faculty, staff and other students, in class, in chats and on any Eduwizz channel.

We may suspend or terminate access without refund for abusive, obscene, threatening, harassing, discriminatory or disruptive behaviour, impersonation, spamming, canvassing other students, promoting competing services, publishing defamatory statements about Eduwizz, or any unlawful use of our services.

Eduwizz is a training and preparation provider only. We do not guarantee that you will pass any examination (including Prometric, DHA, HAAD/DOH, MOH, SCFHS, NHRA, QCHP, OET, IELTS, NCLEX, university or any other test), obtain any licence, eligibility, verification or registration, or receive any job offer, salary, promotion or visa.

Those outcomes rest entirely with examining bodies, health authorities, universities, employers and government authorities, whose rules, fees, syllabi and timelines may change without notice and are outside our control.

Pass rates, testimonials, winner lists and success stories shown on our website, app or social media are examples of past individual results. They are not a representation, warranty or promise about your outcome.

All content is for educational and preparatory purposes only. It is not clinical, medical, legal, financial or immigration advice, and must not be relied on as such in practice.

Where we assist with Dataflow / primary source verification, Mumaris, exam registration, attestation or similar processes, we act only as a facilitator submitting information on your instructions.

• Government fees, authority fees, verification fees and exam fees are payable by you and are collected by those third parties. They are outside our control and are not refundable by us once submitted.
• You are responsible for the accuracy, authenticity and completeness of every document and detail you give us. We are not liable for rejection, delay or additional cost arising from incorrect, incomplete, forged or disputed documents.
• Processing times, outcomes, rejections and rule changes are decided solely by the relevant authority. We give no timeline guarantee.
• Our service charge covers our work in preparing and submitting your application. It is earned on submission and is not refundable based on the authority's decision.

• We collect and process your personal data in line with our Privacy Policy and the Digital Personal Data Protection Act, 2023.
• You consent to Eduwizz contacting you by phone, SMS, WhatsApp, email and in-app notification regarding your enrolment, classes, payments and relevant offers. You may opt out of promotional messages at any time; service messages will continue.
• Classes may be recorded. By joining, you consent to the recording of the session, including your voice, video, name and chat messages, and to that recording being made available to students of the same or future batches.
• You consent to us using your name, photograph, result and testimonial in our winner posters, website, app and marketing material where you have shared them with us for that purpose. You may withdraw this consent in writing at any time and we will stop future use.

We aim to keep our services available but do not guarantee uninterrupted or error-free access. We may carry out maintenance, updates or changes at any time.

We are not liable for any failure or delay caused by events beyond our reasonable control, including internet or power failure, platform or hosting outages, cyber-attack, strike, fire, flood, epidemic or pandemic, natural disaster, war, civil unrest, or any act, restriction or order of a government or authority. Where such an event occurs, we will resume delivery as soon as reasonably possible; this does not give rise to a refund.

We may suspend or terminate your access immediately and without notice if you breach these Terms, share your account or our content, give false information, behave improperly, or have fees outstanding. Termination for breach does not entitle you to any refund, and any unpaid fees remain payable.

You may request account deletion at any time by writing to info@eduwizz.academy. Deletion ends your access and does not entitle you to a refund.

Clauses that by their nature should survive termination, including intellectual property, no-guarantee, indemnity, limitation of liability and dispute resolution, continue to apply after your access ends.

You agree to indemnify and hold harmless Eduwizz Academy, its directors, faculty, staff and partners against any claim, loss, damage, penalty, cost or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse or unauthorised sharing of our content, any false or inaccurate document or information you provide, or any unlawful act by you.

To the maximum extent permitted by law, Eduwizz is not liable for any indirect, incidental or consequential loss, including loss of employment, income, opportunity, examination failure, licence refusal, visa refusal, travel or accommodation costs, or loss of data.

Our total aggregate liability for any and all claims arising out of or connected with your enrolment will not exceed the amount you actually paid to Eduwizz for the specific course or service giving rise to the claim.

Any claim must be brought within 6 months of the event giving rise to it, after which it is waived, to the extent permitted by law.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including your rights under the Consumer Protection Act, 2019.

• These Terms are governed by the laws of India.
• Before starting any formal proceedings, you agree to first raise the matter with our Grievance Officer (clause 17) and allow us 30 days to resolve it in good faith.
• Any dispute not resolved that way shall be referred to a sole arbitrator appointed by Eduwizz under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Kozhikode, Keralaand the language shall be English. The arbitrator's award shall be final and binding.
• Subject to the above, the courts at Kozhikode, Kerala shall have exclusive jurisdiction. This does not affect your right to approach a consumer forum under the Consumer Protection Act, 2019.
• Disputes are resolved on an individual basis. You agree not to bring any claim as part of a class or representative action.

• Severability. If any provision of these Terms is held invalid, unenforceable or excessive by a court or authority, it shall be modified to the minimum extent necessary to make it valid, or severed. All remaining provisions continue in full force.
• Entire agreement. These Terms, together with the enrolment details confirmed to you, form the whole agreement between us. No verbal assurance, promise or representation by any staff member, counsellor, agent or third party binds Eduwizz unless confirmed by us in writing.
• No waiver. If we do not enforce a right on any occasion, that is not a waiver of that right.
• Assignment. You may not assign or transfer your rights. We may assign our rights and obligations to a successor or group entity.
• Notices. Notices to you are validly given to the phone number, WhatsApp number or email address on your account. Notices to us must be sent to info@eduwizz.academy.
• Language. Where these Terms are translated, the English version prevails.

We may update these Terms from time to time. The updated version will be published here and in the App with a revised date, and for material changes we will ask you to accept them again at sign-in. Continued use of our services after an update means you accept the updated Terms.
